Tom maintains a general civil trial practice, including construction contract litigation, professional negligence claims, including legal and medical malpractice, business ownership disputes, employment matters, personal injury claims and real estate litigation matters. His practice has included numerous court and jury trials as well as arbitrations. Representative cases include:

  • A $4.1 million verdict on behalf of a motorcyclist injured as a result of an unsafe highway.
  • A $1.4 million award on behalf of a general contractor arising from a construction project for Caltrans in which the owner caused delays that impacted the general contractor.
  • An action against an insurance company which had acted in bad faith in refusing to defend its policyholder in a lawsuit in which the policyholder had incurred over $3.5 million in defense costs. After the jury found the insurance company had committed bad faith and awarded the full $3.5 million in defense costs, the case settled on confidential terms before further trial proceedings.
  • An action against an insurance company which refused to pay “long term” healthcare benefits to its policyholder, based on the insurance company’s claim the policyholder had failed to disclose material medical conditions in his insurance application. The case was settled for full policy benefits, and an additional confidential amount.
